Terms of Use

The owner of the webshop kukirinscooters.eu (hereinafter the Webshop) is KS Capital OÜ, VAT no. EE102291652, registry code 14909139, address Ringtee tn 14, Põltsamaa, Jõgeva County, 48106, Estonia, e-mail info@kugooeesti.ee.

This Warranty Policy sets out the terms and conditions of the manufacturer’s and seller’s warranties for products purchased from the Webshop, including the scope, duration, and procedures for making a warranty claim.

This Policy applies to all purchases made from the Webshop and forms an integral part of the Webshop’s Terms of Use. In matters not regulated by this Warranty Policy, the Terms of Use and applicable Estonian and European Union legislation shall apply.

KS Capital OÜ reserves the right to amend this Policy. Any changes will be published on the Webshop website and shall apply to products purchased after the amended policy enters into force.Price and product information

All prices in the KugooEesti e-shop are in euros and include 24% Estonian VAT.

Where discounts are available, the reduction is applied after entering the discount information in the shopping cart.

Information about the goods is provided in the Webshop directly next to the product.

KS Capital OÜ has the right to change the prices displayed in the e-shop at any time. If the prices in the e-shop change after you have placed an order and paid for it, KS Capital OÜ undertakes to deliver the respective products at the prices valid at the time of the order. The customer is not entitled to claim compensation for the price difference.


Making a purchase and placing an order

The Buyer selects the desired products in the Webshop and adds them to the cart.

Quantities can be changed and products removed from the cart until payment has been made.

To place the order, the required data fields must be completed and a payment environment selected.

The order is considered finalised after pressing the Pay button.

The Webshop will send an order confirmation to the Buyer’s e-mail address.

If the product chosen by the Buyer cannot be delivered due to it being out of stock or for any other reason, the Buyer will be notified at the earliest opportunity and the Seller has the right to cancel the order in whole or in part. In the case of partial cancellation, the Seller may ask the Buyer to clarify how to proceed with the remaining order—whether to dispatch it or cancel it as well.

The sales contract is deemed concluded when the Client has paid 100% of the order amount to KS Capital OÜ’s bank account.


Payment

The Buyer pays the sales price of the goods and the delivery fee in full in advance.

Payment for the order is made outside the KugooEesti web environment in a secure payment gateway. For bank link payments, Montonio is used. In Montonio’s secure environment, the client can pay via bank link in the following banks: Swedbank, SEB, Luminor, LHV, Coop. KS Capital OÜ has no access to the client’s credit card or bank account data.

The order will be cancelled if the purchase amount is not received in KS Capital OÜ’s bank account within 10 days.

KS Capital OÜ is the controller of personal data.


Delivery

Shipping costs are borne by the Buyer.

Outside Estonia, delivery takes place within 30 calendar days.

In exceptional cases, delivery may take up to 60 calendar days.

Within Estonia, shipments generally reach the Buyer’s specified destination within 10 working days from the entry into force of the sales contract.

The delivery method is chosen by the Seller. The Seller will choose delivery to a parcel machine if the product fits within the maximum locker dimensions 39 × 38 × 64 cm and if a parcel machine is located within 500 meters of the Buyer. The distance to the parcel machine is determined on the basis of the Buyer’s submitted data and the web-based location services of AS Eesti Post (Omniva) or DPD Eesti AS. If the product is larger than the maximum locker size or if the parcel machine is more than 500 meters from the address provided by the Buyer, the Seller will choose courier delivery via AS Eesti Post (Omniva) or DPD Eesti AS.

When placing the order, the Buyer should ensure the accuracy of the contact details provided in order to avoid delays and misunderstandings during delivery. The Seller and the courier company are not liable for delivery delays or misunderstandings if these are caused by inaccurate or incorrect information provided by the Buyer when placing the order.

The courier will deliver the goods together with the accompanying documentation within the timeframe specified in the product description or in the order.

The courier delivers the goods to the address indicated by the Buyer when placing the order. The destination cannot be changed later.

Before signing the waybill, we strongly recommend that you inspect the packaging and, in case of any external damage, note it on the courier’s waybill. Please report a product with damaged packaging by e-mail to info@kugooeesti.ee. A product with packaging damaged by the courier will be replaced.

The delivery conditions apply only within the Republic of Estonia. If you wish to order abroad, please contact the Seller’s customer service.



Dispute resolution

If the Buyer has complaints against the Seller, please send them by e-mail to info@kugooeesti.ee.

Disputes arising between the Seller and the Buyer shall be resolved by negotiation. If no agreement is reached, the Buyer has the right to turn to the Consumer Protection and Technical Regulatory Authority (Rahukohtu 2, Tallinn 10130, http://www.tarbijakaitseamet.ee) and the Consumer Disputes Committee (Rahukohtu 2, Tallinn 10130, http://www.komisjon.ee) for out-of-court resolution, or to go to court. In addition, all customers can use the EU ODR platform (Online Dispute Resolution) for resolving disputes with e-traders at http://ec.europa.eu/odr.


Exclusion clauses

Product images on the website are illustrative.

KS Capital OÜ reserves the right to refuse a sale if one of the following problems has occurred with the product: a human error in entering the price or a technical error in the system (for example, if an electric scooter costing €1000 is suddenly on sale for €100, this is clearly an error. We therefore assume that the customer understands this and that the product is not for sale at such a price).
