Return Policy
The owner of the webshop kukirinscooters.eu (hereinafter the Webshop) is KS Capital OÜ, VAT no. EE102291652, registry code 14909139, address Ringtee tn 14, Põltsamaa, Jõgeva County, 48106, Estonia, e-mail info@kugooeesti.ee.
This Return Policy regulates the Buyer’s right of withdrawal from the sales contract, the conditions and procedure for returning goods, and the handling of non-conforming or defective products purchased from the Webshop.
This Policy applies to all purchases made from the Webshop and forms an integral part of the Webshop’s Terms of Use. In matters not regulated by this Return Policy, the Terms of Use and applicable Estonian and European Union consumer protection legislation shall apply.
KS Capital OÜ reserves the right to amend this Return Policy. Any changes will be published on the Webshop website and shall apply to orders placed after the amended policy enters into force.
Order cancellation and product returns
The Buyer has the right to withdraw from the sales contract concluded in the Webshop within 14 days of receiving the order.
The right of withdrawal does not apply if the Buyer is a legal person.
To exercise the 14-day right of return, the goods may not be used in any way other than is necessary to determine the nature, characteristics, and functioning of the goods, as would be permitted in a traditional retail shop.
If the Buyer has used the goods for purposes other than necessary to determine their nature, characteristics, and functioning, or if the goods show signs of use or wear, the Seller has the right to reduce the refundable amount in proportion to the decrease in the value of the goods.
If the goods are defective, the Seller has the right to demand that the Buyer reimburse the transport costs of returning the goods, according to the price list of the carrier providing the return service (e.g. Omniva or DPD).
The Buyer has the right to return the goods at their own expense. KS Capital OÜ does not reimburse postage costs related to the return of goods.
To return the goods, a declaration of withdrawal from the sales contract must be submitted no later than 14 days from receipt of the goods. The withdrawal declaration must be sent by e-mail to info@kugooeesti.ee. The declaration must include: reason for return, the Buyer’s first and last name, and the name of the product being returned.
The Webshop will confirm receipt of the withdrawal declaration to the Buyer by e-mail.
The Seller has the right to refuse to sell the goods where, due to a technical error, the price of the product offered in the Webshop has changed/been changed to be unreasonably low compared to the product’s usual market price (pricing error), there is no explicit information next to the product that it is a special price, and the goods have not yet been handed over to the Buyer. The Seller has the right to withdraw from such a transaction within 3 working days from becoming aware of the transaction concluded with a pricing error, by submitting to the Buyer a statement in a form that can be reproduced in writing. In the event of withdrawal on this basis, the Webshop will promptly, but no later than within 14 days, refund to the Buyer all payments received under the contract, including delivery charges. All payments will be made to the Buyer’s bank account from which the goods were paid.
Products returned from repair and, after the relevant information has been provided to the client, must be kept by KS Capital OÜ for 3 months. After this period, KS Capital OÜ has the right to dispose of the goods.
Return of non-conforming goods
KS Capital OÜ is not liable for:
deterioration/damage to the product due to the Buyer’s fault;
defects resulting from improper use of the product;
normal physical wear and tear of the product during ordinary use.
In the case of returning a non-conforming product, the amount paid for the product (including shipping costs) will be transferred to the bank account you specify no later than 14 days from the receipt of the notice of withdrawal and the wish to return the product.
In addition to rights arising from the manufacturer’s warranty, the Buyer also has other rights arising from law.
