Warranty Policy
The owner of the webshop kukirinscooters.eu (hereinafter the Webshop) is KS Capital OÜ, VAT no. EE102291652, registry code 14909139, address Ringtee tn 14, Põltsamaa, Jõgeva County, 48106, Estonia, e-mail info@kugooeesti.ee.
This Warranty Policy sets out the terms and conditions of the manufacturer’s and seller’s warranties for products purchased from the Webshop, including the scope, duration, and procedures for making a warranty claim.
This Policy applies to all purchases made from the Webshop and forms an integral part of the Webshop’s Terms of Use. In matters not regulated by this Warranty Policy, the Terms of Use and applicable Estonian and European Union legislation shall apply.
KS Capital OÜ reserves the right to amend this Policy. Any changes will be published on the Webshop website and shall apply to products purchased after the amended policy enters into force.
Price and product information
All prices in the KugooEesti e-shop are in euros and include 24% Estonian VAT.
Where discounts are available, the reduction is applied after entering the discount information in the shopping cart.
Information about the goods is provided in the Webshop directly next to the product.
KS Capital OÜ has the right to change the prices displayed in the e-shop at any time. If the prices in the e-shop change after you have placed an order and paid for it, KS Capital OÜ undertakes to deliver the respective products at the prices valid at the time of the order. The customer is not entitled to claim compensation for the price difference.
Manufacturer’s warranty
The manufacturer’s warranty covers material and workmanship defects occurring within the period specified by the manufacturer. The manufacturer’s warranty does not allow replacement with a new device or withdrawal from the sales contract. The warranty does not cover costs arising from the use of the products, data loss, loss of productivity, or similar cases. Warranty periods and service levels may differ by device. The manufacturer’s warranty applicable to a device is set out in the documentation accompanying the device. Please review the specific manufacturer warranty terms applicable to the product before purchasing.
The manufacturer’s warranty becomes void if:
non-authorised service centres (not authorised by the manufacturer) have been used for prior repairs;
severe mechanical damage (e.g. deformed casing, crushed screen) or liquid/moisture damage is detected;
the warranty period has expired.
The manufacturer’s warranty does not extend to:
packaging, documentation, consumables, licences, software, and installation media;
disruptions caused by accidental or intentional damage by the user;
disruptions caused by modification of the device’s technical characteristics by an uncertified person or service;
malfunctions caused by non-compliance with the user manual;
errors caused by software;
cleaning of the product;
user training;
disruptions caused by connecting the product to a non-compliant power supply (including ungrounded);
disruptions caused by software installed by the client;
products and parts whose serial numbers, control stickers, or marking labels are tampered with, replaced, or removed.
Submitting claims and liability
If the Seller is responsible for defects in the goods, the Seller will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Seller will refund to the Buyer all payments received under the contract.
Upon the occurrence of a defect, the Buyer has the right to contact the Webshop no later than within two months, by sending an e-mail to info@kugooeesti.ee, describing the defect found in the product and the content of the claim, and attaching proof of purchase.
KS Capital OÜ will not rectify free of charge defects that appear during the period for submitting claims if they are caused by:
software errors installed on the device;
normal wear and tear;
incorrect use or maintenance (including if the device has been repaired or maintained by a person not authorised by the manufacturer);
tampering with, replacing, or removing the serial number, control sticker, or marking label of the device and/or part;
defects notified to the client by KS Capital OÜ before purchase;
external factors. External factors include, among other things, lightning, non-compliant voltage and voltage fluctuations, moisture, liquid, mechanical damage, etc.;
the product not working due to the owner’s fault, improper operation, failure to follow the user manual, or if defects occurred due to careless storage, maintenance, or overloading of the product.
In determining liability, KS Capital OÜ relies on an expert assessment (diagnostics) performed by the manufacturer’s authorised representative. If the expert assessment shows that the defects are caused by the factors listed above, but the device can be repaired, the Consumer may order paid repair. A device with liquid/moisture damage and/or mechanical damage will in the future also be repaired on a paid basis only.
If the consumer does not agree with the position of KS Capital OÜ, the consumer must prove that:
there is indeed a defect (based on an expert opinion);
the defect or its cause existed at the time of handover of the device;
KS Capital OÜ is responsible for the defect.
